On January 29, OSHA issued new guidance to help employers and workers implement a COVID-19 protection program and better identify risks that could lead to exposure and contraction. While OSHA recognizes in the guidance that the contents are “not a standard or regulation” and the document “creates no new legal obligations,” the agency also expressly reminds employers that they are obligated to comply, not only with specific OSHA standards, but also with the Occupational Safety and Health Act’s “General Duty Clause.”
The guidance recommends several elements in a prevention program:
Conducting a hazard assessment
Identifying control measures to limit the spread of the virus
including physical barriers and face coverings over the nose and mouth
Adopting policies for employee absences that don’t punish workers as a way to encourage potentially infected workers to remain home
Ensuring that coronavirus policies and procedures are communicated to both English and non-English speaking workers
Implementing protections from retaliation for workers who raise coronavirus-related concerns.
Keep in mind that President Biden’s executive order still calls on OSHA to develop a full Emergency Temporary Standard by March 15 if OSHA deems it necessary.
